  1. What information we collect from you

Your information will have been collected:

Through www.win-the-prize.com, a website owned and operated by ABY Marketing Dreams. When you registered, you will have provided your gender, first and last name, date of birth, email address, telephone number, postal address and other information used for marketing. You will also have told us what kind of offers you are interested in. You will have ticked the boxes to confirm that you are interested in receiving marketing offers.

  1. Why do we collect this information?

We collect this information because it is the basis of our business. We provide the following services to our customers:

Information: To make sure you receive offers that are relevant to you, our customers use your information and information about other people to decide the best way to reach your destination. They do this by creating models that help our clients target their marketing campaigns effectively. This means you should only receive offers that are relevant to you.

Marketing: As explained above, our business provides personal data to our customers for their marketing campaigns. For example, if a new golf club is opening near you, the owner may come to us and ask for a list of people within certain postcodes, aged between 18 and 60, who like golf. We will provide that list on the basis that the golf club owner will contact you to see if you would be interested in becoming a member.

Data hygiene: we must ensure that the information we hold about you is kept up to date, relevant and accurate. To do this, we compare it against lists of people we know who have moved or died, the Telephone Preference Service and the Mail Preference Service.

  1. WHAT IS THE PURPOSE OF THE PROCESSING?

You can be assured that your information will only be used in accordance with this Privacy Policy.

PURPOSE 1: To manage the participation of the interested party in draws and/or promotions organised by ABY MARKETING DREAMS.

PURPOSE 2: Commercial exploitation of the database through the sending of commercial communications from third parties or market research. For this purpose, it is necessary to subject the data of the interested parties to standardisation, deduplication, filtering and verification operations. The commercial communications will be sent directly by ABY MARKETING DREAMS without the physical delivery of the data of the interested parties to the advertisers.

PURPOSE 3: To communicate the data of the interested parties to companies, organisations and/or entities interested in directing advertising actions to them in the sectors of activity indicated above, or to carry out market research. This will necessarily involve the need to submit your personal data to standardisation, deduplication, filtering and verification operations. Advertising actions, both those carried out by ABY MARKETING DREAMS and by third party companies/entities, may be carried out through the following channels: email, post, telephone calls to landlines or mobiles, sending SMS and/or MMS messages, multi-platform messaging services, chat or any type of analogue communication, In addition to the data requested from the interested party through the registration form, ABY MARKETING DREAMS also stores the IP and browsing data of the interested party. All of this is for the purpose of preventing fraud or technological fraud. Retention of your data: The purpose of this Personal Data Retention Policy is to establish guidelines for determining when data should be retained or destroyed in order to comply with the requirements of the duty of quality. What personal data do we keep? The data that we keep in our files must consist of date of registration, IP address, name, surname, first name, gender, age, email, telephone number and postcode. Optionally, you may provide us with your postal address. Likewise, optionally and by means of a survey, we will ask you for another series of data that you can freely answer. These data refer to profile data such as whether you own a car, its make and model, whether you have private health insurance, which telephone company you use, etc... This data will be kept together with the rest of the compulsory data until you are removed from our file. As a general rule, all your data will be automatically cancelled for all the purposes for which you accepted the treatment, five years after your registration date (the limitation period for actions derived from a contractual relationship has been taken as a reference, which is five years). Periodically, if you are an active user, i.e. you open and visit the offers sent to you, you will receive emails reminding you that your personal data are stored in our database, as well as the processing(s) to which you gave your consent. In all these emails, you will be given the option to cancel the processing or to unsubscribe permanently from our file. If you expressly gave your consent to receive advertising communications from third party companies via telephone or sms, your data will be automatically cancelled five years after your registration date, unless you have exercised your right to unsubscribe prior to this period, in which case you will be permanently unsubscribed at the time of the request. You will have the opportunity to change your marketing preferences at any time by accessing your private area with your access codes. You may request access codes to your private area at any time.

  1. Legitimate interest

We have already told you about our legitimate interest in keeping your data, but there are others. We are permitted to share information with other companies that use such information for non-marketing purposes (including risk and credit assessment and management, fraud identification and prevention, debt collection and asset recovery). This would include information you provide to us today, at any time in the past and in the future.

  1. How long do we keep your information?

Our databases are updated every 3 months and we will also carry out regular double-checks by comparing your data with the records we mentioned above. If your data is older than 3 months or if you have asked us to remove you from our databases, we keep a version of your record in our suppression file. This is for two reasons:

We need to keep a record that says you do not wish to be contacted. We find that information often comes to us from more than one source so the only way to ensure that it is not re-entered into the database is to have a record that we can verify.

If you ask us to provide you with all the information we hold about you, then we need a record from you to search our old databases to understand when your information was originally passed to us and by whom.

  1. Requests, enquiries and unsubscribing

If you change your mind about us processing your personal information at any time, we must respond to your requests. You may:

Ask for a copy of the information we hold about you.

This is called a subject access request and we must:

Tell you whether your personal information is being processed;

Give you a description of the personal information, the reasons why it is being processed and whether it will be given to other organisations or individuals;

Give you a copy of the information comprising the data; and give you details of the source of the data (where available).

We will ask you for proof of identification before complying with your SAR. We must respond to you within 30 days. We may take time to ensure that we have verified all our records.

  1. Complaints Procedure

If you have a complaint about the use of your information, please contact the Data Protection Office using the details provided above. We will carry out a full investigation into the use of your information. We aim to respond to all complaints without undue delay, or in any event, within 28 days of receipt.

  1. Requests, enquiries and complaints relating to personal injury claims and financial claims

If you are contacting us because a company has contacted you about personal injury or financial claims then you have additional rights. You should continue to use the contact details we have set out above and we will:

Automatically acknowledge any email within 24 hours;

Acknowledge any postal request within 5 working days of receipt;

In our response, provide the name of who should handle your complaint, how the timescales will be progressed and contact details for the Legal department should you be dissatisfied with the way your complaint is handled.

Within 8 weeks of receipt of your complaint, a final response will be provided:

a final response detailing the information you requested ; or

an explanation of the delay and an indication of when we expect to be able to provide a final response.

If you are not satisfied with the way your complaint has been handled or resolved, you must refer your complaint to the Legal Department within 6 months of the date of the written response detailing how your complaint will be handled.

  1. Changes to this privacy policyWe may need to update or change this privacy policy from time to time. When we do, we will make it clear on the win the prize website that we have done so.
